This Privacy Notice is issued in accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Private Parties (hereinafter the "LFPDPPP") and its Regulations, according to the following terms and conditions:

The personal data we collect are used for the purposes necessary for the execution of our services, consisting of: (i) sending information, brochures, and news of any nature that Mercury considers may be of interest to you, as well as news, communications or advertising related to Mercury; (ii) holding meetings and conversations and carrying out activities arising from the relationship between you and Mercury, including sending documents; (iii) sending notifications regarding modifications to the Privacy Notice; (iv) providing security to our customers; and (v) complying with applicable privacy regulations in force, as well as all applicable legal obligations and all requirements of the corresponding authorities.
D. BY WHAT MEANS WE OBTAIN PERSONAL DATA.
For the purposes outlined in the Privacy Notice we may collect your personal data in different ways, either (i) you provide it to us directly; (ii) you visit our website and provide data through that means; and (iii) we obtain information through other sources permitted by applicable privacy regulations..
E. TACIT CONSENT TO THE PROCESSING OF YOUR PERSONAL DATA.
If you do not express your opposition to the processing of your personal data, it will be understood that you have given your tacit consent to this, the above, at the time of accessing, registering or using the website or providing data directly to us. However, in the event that you do not consent to your personal data being processed in the terms set forth in the Privacy Notice, please indicate this in the respective option at the time you are registering as a Mercury customer by the appropriate means.
By consenting to the transfer of personal data to Mercury, you acknowledge and agree that Mercury may transfer your personal data to third parties, including sponsors, advertisers, contractors and/or business partners..
You acknowledge and agree that Mercury does not require any authorization or confirmation from you to make any transfer of personal data pursuant to the provisions of Article 37 of the LFPDPPP..
F. LIMITATION OF THE USE OF YOUR PERSONAL DATA.
You may opt out of receiving information of any nature from Mercury, either personally, via email or by telephone, by notifying the Controller at the address provided in the first section of this Privacy Notice.
G. EXERCISE OF YOUR RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION AND OPPOSITION.
You have the right to (i) access your personal data in our possession and the details of the processing thereof; (ii) rectify your personal data if it is inaccurate or incomplete; (iii) cancel your personal data when you consider that it is not required for any of the purposes set forth in the Privacy Notice, is being used for non-consensual purposes or the business relationship has ended; or (iv) oppose the processing of your personal data for specific purposes (hereinafter collectively, the "ARCO Rights").
The mechanisms that have been implemented for the exercise of the ARCO Rights are through the presentation of the request that you provide to the person in charge, in accordance with the following:
Your request must contain the following information: (i) the full name and address of the holder of the personal data, your email or other means to communicate the response to your request; (ii) the documents proving the identity or, as the case may be, the legal representation of the holder; (iii) a clear and precise description of the personal data with respect to which the holder seeks to exercise any of the ARCO Rights; (iv) the place and date on which the request to exercise the ARCO Rights is generated and delivered to Mercury; (v) the signature of the holder of the personal data; and (vi) reference or indication of the original information of the holder of the personal data. The foregoing in the understanding that if the holder of the personal data does not comply with the delivery of the provisions of items (i) to (vi) above, the request for the exercise of the ARCO Rights will be deemed not to have been requested to Mercury.
Within a maximum period of 20 business days we will respond to your request and will inform you free of charge about the merits of the request, under the terms of the LFPDPPP, through a notification to the owner of the personal data to your (i) address; or (ii) email. In the event that your request is granted, it shall be effective within a maximum period of 15 business days from the date on which the response to the request is communicated.
H. REVOCATION OF CONSENT TO THE PROCESSING OF YOUR PERSONAL DATA.
At any time, you may revoke the consent you have given to Mercury for the processing of your personal data, in order for us to stop using them.
Your request must be submitted through Mercury's e-mail address.
Likewise, your request must be accompanied by the following information: (i) the full name and address of the holder of the personal data, his email or other means to communicate the response to his request; (ii) the documents proving the identity or, if applicable, the legal representation of the holder; (iii) the clear and precise description of the personal data in respect of which the revocation of the consent given to Mercury for the processing of the personal data is sought; (iv) the place and date in which the request is generated and delivered to Mercury for the processing of the personal data; (v) signature of the holder; and (vii) the name and address of the person who is the subject of the request. The foregoing in the understanding that if the holder of the personal data does not comply with the delivery of the provisions of items (i) to (vi) above, your request for revocation of consent shall be deemed not requested to Mercury.

I. INFORMATION SECURITY.
Mercury has physical, electronic and administrative procedures in place to protect personal information against accidental or legal destruction, unlawful loss or alteration, and unauthorized disclosure or access.
J. MODIFICATIONS TO THE PRIVACY NOTICE.
We reserve the right to modify or update the Privacy Notice at any time in order to comply with legislative reforms, new jurisprudential developments, internal policies or new requirements for the offering of our products and market practices.
These modifications will be available to the public through our website, in the Privacy Notice section.
K. APPLICABLE LAW, JURISDICTION AND COMPETENCE.
The Privacy Notice is governed by the Privacy Regulation and other applicable federal legal provisions in force in Mexico. The acceptance of the Privacy Notice implies your express submission to the competent courts in Mexico City, for any controversy or claim arising therefrom.
